Has anyone experience a case where the alert rule on the on node system reporter will not send email. all settings configured correctly and reports are received by email (suggesting that SMPT/recipient is ok) but the alert wont work. any reason?
Does this require the management CLI to be installed?

Lets see your alert definition. Are you certain the alert threshold has been triggered?
